Certainly. Marshaling estate assets is essentially a comprehensive inventory of everything the deceased person owned at the time of their passing. This includes bank accounts, real estate, vehicles, investments, personal belongings, and even digital assets like social media accounts or cryptocurrency holdings.

It’s crucial to be thorough during this stage because every asset must be accounted for and ultimately distributed according to the terms of the will or intestate succession laws. Ordinarily, we work closely with the executor or administrator to gather documentation such as account statements, deeds, titles, and appraisals to accurately assess the value of each asset.

Once a complete inventory is compiled, it’s filed with the probate court as part of the formal accounting process. This ensures transparency and accountability throughout the probate proceeding.

Brenda Miller: I imagine that can be a complex process, especially when dealing with extensive estates. Have you ever encountered any challenges during this stage?

Yes, there have been times where locating all assets proved to be quite difficult. For instance, I once represented a family where the deceased had several hidden bank accounts. It took some diligent detective work and collaboration with financial institutions to uncover these assets.

In another case, we discovered that the decedent owned valuable artwork that wasn’t properly documented or insured. We had to bring in art appraisers to determine its worth, which ultimately added significant value to the estate.

Notwithstanding these challenges, it’s always gratifying to ensure that every asset is accounted for and distributed according to the deceased person’s wishes. That peace of mind is invaluable to grieving families.

Absolutely. And it’s worth noting that according to the California Bar Association, approximately 70% of Californians die without a valid will in place. This underscores the importance of proper estate planning to avoid potential complications during probate.
