Choosing the right person – or entity like a bank or trust company – to manage your estate after you’re gone is incredibly important. Consequently, this individual will be responsible for carrying out your wishes as outlined in your will or trust. They handle everything from paying debts and taxes to distributing assets to your beneficiaries.
Ordinarily, people select a trusted family member or close friend, someone they believe is responsible, organized, and capable of handling potentially complex financial matters. However, it’s crucial to have an open and honest conversation with this person beforehand about the responsibilities involved.
Notwithstanding their good intentions, some individuals may not be prepared for the emotional and logistical challenges of being an executor. Moreover, it’s important to consider whether there might be potential conflicts within the family that could complicate matters.

That’s great advice, Steve! Have you ever encountered any challenges related to executor selection in your practice?
Steve Bliss:
Certainly. I recall one instance where a client named their adult son as the executor, but unfortunately, there were underlying family tensions. After the client passed away, these tensions escalated, leading to disagreements and delays in settling the estate.
Ultimately, it caused significant stress and heartache for everyone involved. In hindsight, it might have been beneficial to consider a neutral third party, like a trust company, to handle the administration of the estate in that particular case.

That’s a poignant example, Steve. What advice would you give to readers who are considering their own executor selection?
Steve Bliss:
First and foremost, choose someone trustworthy and capable. Discuss your wishes openly with them beforehand, ensuring they understand the responsibilities involved.
Remember, it’s perfectly acceptable – even advisable in some cases – to consider a professional executor like a trust company, especially if family dynamics are complex or you have a large and complicated estate.
- Document your wishes clearly in your will or trust. Be specific about how assets should be distributed and any conditions you may want to impose.
- Regularly review your choice of executor, as circumstances can change over time.
